Drug Control: Difficulties in Denying Federal Benefits to Convicted Drug Offenders

ANNOTATION: Section 5301 of the 1988 Anti-Drug Abuse Act grants federal and state judges the sentencing authority to make convicted drug offenders ineligible for certain federal benefits, including: all federal contracts, and 400+ federal grants, licenses and loans. This report reviews the impact of the legislation in three areas: court and agency efforts to deny access to the benefits, the effects of benefit denial on drug offenders, and the potential for mandatory benefit denial upon conviction for a drug offense. The study focused on drug offender sentencing in Florida, Michigan, Mississippi, New York, and Rhode Island.
