ANNOTATION: The rate at which Florida uses prosecutorial waiver is nearly equal to that of the rest of the nation combined. Even though the use of prosecutorial waiver has been in effect since 1981, Florida has the second highest overall violent crime rate in the U.S., with the juvenile crime rate for the state being 48% higher than the national average. Studies have shown that youth who are sent to adult courts recidivate at higher rates than those youth sent to the juvenile justice system. Black youths are 2.3 times more likely than white youth to be sent to adult courts in Florida. After review, Florida's use of prosecutorial waiver results in serious problems.
