ANNOTATION: Information regarding the non-exemption of first responders (i.e., police officers, correctional officers, parole or probation officers, etc.) under Section 13(a)(1) of the FLSA is provided. First responders do not qualify as exempt employees because their primary duty is not management. They are therefore protected by the minimum wage and overtime provisions of the FLSA.
