A Tale of Two Laws Revisited: Investigating the Impact of the Prisoner Litigation Reform Act and the Antiterrorism and Effective Death Penalty

ANNOTATION: The divergent effects of the Prisoner Litigation Reform Act (PLRA) compared to the Antiterrorism and Effective Death Penalty Act (AEDPA) are analyzed and commented on. Following an executive summary, this report is divided into three parts: the effect of PLRA on the filing rate of Section 1983 lawsuits; the effect of AEDPA on the filing rate of State Prisoner Habeas Corpus Petitions; and conclusions -- five lessons to be learned from this dual set of policy initiatives. While the PLRA achieved its intended results, the AEDPA did not.
