ANNOTATION: It is argued by a group of amici, led by the Florence Immigrant and Refugee Rights Project, that "protracted and unreasonable periods of detention pending removal proceedings . . . degrade constitutional due process protections" (p. 7-8). Sections of this document include: table of authorities; interests of amici; introduction; argument -- the government subjects individuals to unnecessary and prolonged immigration detention while it litigates meritorious claims, protracted removal proceedings are further extended by the agency's dilatory appeals and administrative error, individuals with strong community ties who pose no danger or flight risk languish needlessly in detention which serves no governmental interest, people for whom there is no foreseeable possibility of removal are nonetheless subject to prolonged detention, and the occurrence of prolonged detention is so frequent and widespread that many individuals abandon claims with high likelihoods of success; and conclusion.
