ANNOTATION: The Supreme Court found that a District Judge "may consider the disparity between the [Federal Sentencing] Guidelines' treatment of crack and powder cocaine offenses" when determining an offender's sentence. Under the "United States v. Booker," the cocaine Guidelines (like any other Guideline) are advisory only, not mandatory. The judgment of the U.S. Court of Appeals for the Fourth Circuit is reversed.
