Signed into law on December 16, 2016, the PREA amendment under the Justice for All Reauthorization Act of 2016 includes a number of important changes to the PREA statute, including the requirement for the U.S. Attorney General to request that governors send to the U.S. Department of Justice all final PREA audit reports for confinement facilities that are under the operational control of their states' and territories’ executive branch.

H.R.5682 - FIRST STEP Act (2018)

Passed in 2018, the Formerly Incarcerated Reenter Society Transformed Safely Transitioning Every Person Act or the FIRST STEP Act provides for, among other purposes, programs to help reduce the risk that prisoners will recidivate upon release from prison.

Juvenile Facility Standards: U.S. Department of Justice Final Rule: National Standards to Prevent, Detect, and Respond to Prison Rape Under PREA

PREA standards for juvenile facilities are divided into the following sections: Prevention Planning, Responsive Planning, Training and Education, Screening for Risk of Sexual Victimization and Abusiveness, Reporting, Official Response Following a Resident Report, Investigations, Discipline, Medical and Mental Care, Data Collection and Review, Audits, Auditing and Corrective Action, and State Compliance.

PREA Data Collection Activities, 2025

This report fulfills the mandate established by the Prison Rape Elimination Act of 2003 (PREA; P.L. 108–79) that requires BJS to produce a report, not later than June 30 of each year, on BJS’s activities to collect data on prison rape. It is the 18th in a series on PREA data collection activities that BJS began publishing in 2009. It describes BJS’s data collection efforts in 2025 to measure the incidence and prevalence of rape and sexual assault in adult correctional and juvenile justice facilities, including through three independent collections: the Survey of Sexual Victimization, the National Inmate Survey, and the National Survey of Youth in Custody. Estimates from these collections are not directly comparable.

Sexual Victimization In Correctional Facilities

PREA requires the Bureau of Justice Statistics to carry out a comprehensive statistical review and analysis of the incidence and effects of prison rape for each calendar year.

Report on Sexual Victimization in Prisons, Jails, and Juvenile Correctional Facilities

This report presents the findings and recommendations of the Review Panel on Prison Rape and is based on hearings held in 2014 and two national surveys of correctional facilities by the Bureau of Justice Statistics for the years 2011-12.
