Arizona Court of Appeals ruled that a cap to restitution is unconstitutional. In 2006, the Arizona legislature passed a law that requires those who are convicted of a traffic offense that causes serious physical injury or death to pay restitution, but limited that payment to no more than $10,000. The amount was later increased to $100,000. This case hinged on an award of restitution by the municipal judge for injury in a traffic accident to the victim for $61,192. That award was appealed by the man convicted in the case.

Research has shown that lesbian, gay, bisexual, and transgender (LGBT) people face a higher risk of sexual victimization in confinement. Recent Bureau of Justice Statistics surveys found that adults and youth in confinement who identify as lesbian, gay, or bisexual were much more likely to have experienced sexual victimization by another inmate than their heterosexual counterparts.

With almost 28,000 respondents, the U.S. Transgender Survey (USTS) is the largest survey ever devoted to the lives and experiences of trans people. The staff of the National Center for Transgender Equality (NCTE) and the rest of the USTS team are thrilled to share the results of the USTS with you.

Jails are traumatizing and often dangerous places, especially for lesbian, gay, bisexual, and transgender people, and anyone who is gender nonconforming. In a country that incarcerates more of its people than any other in the world, LGBT people are more likely to end up behind bars, and more likely to face abuse behind bars. Being LGBT in a US jail or prison often means daily humiliation, physical and sexual abuse, and fearing it will get worse if you complain. Many LGBT people are placed in solitary confinement for months or years just because of who they are.
